Covenants, Conditions, & Restrictions

Covenants, Conditions & Restrictions (CC&Rs) are the rules governing the use of real estate, usually enforced by a homeowners’ association, and passed on to you when you purchase a property. They are the governing documents that dictate how the homeowners association operates and what rules the owners must follow. For example, CC&Rs may tell you square foot requirements, siding options you can use, how you can use your land or whether you can have pets. Some Chattanooga neighborhoods use the restrictions to the extreme to determine if you can keep your boat in your driveway or when you are allowed to put your trash cans out. Each subdivision’s rules are different so you need to make sure to read them carefully before you purchase a lot or a home in a neighborhood.

The attached list of Covenants, Conditions & Restrictions are only a few of the Chattanooga, Signal Mountain, Ooltewah and Hixson area communities for which I have obtained restrictions. These documents do change from time to time and in some neighborhoods. Each phase of a subdivision can be different, so do consider that these documents may be a starting point only. 

The other thing to remember that Covenants and Restrictions can expire over time. Sometimes there may be Covenants, Conditions & Restrictions for a neighborhood but no established homeowners association to enforce them.
